Collaborative Law
Jacky Creswick, solicitor and head of our Family Law Dept is a qualified Collaborative Law Practitioner.
The collaborative process enables couples who are separating or divorcing to reach solutions together, avoid the Court process and in doing so ease the pain of relationship breakdown and create the best chance of building a brighter future.
Instead of the traditional model of each party having a solicitor working exclusively for them they sit down together with both lawyers in 4 way meetings to work out the best solutions for the family. Both parties and especially any children benefit from this approach.
For the process to succeed it needs commitment from everyone involved and especially:
- A genuine desire by both parties to make it work.
- A willingness to disclose (in financial matters) fully and honestly information about income and assets.
- Skilled trained solicitors who are practised in working in a collaborative way.
- An agreement that you will reach solutions without going to court.
This is a new approach which gives you the benefit of your own independent legal advice but leaves you both in control without the threat of court proceedings.
If you and your partner genuinely seek a fair solution to issues arising from your separation and you want to minimise the pain of the breakdown the collaborative process might offer you the best way forward.
